What applies when you rent a boat at Molo Cafe.

Rules for renting motorboats without a licence in Sława

The boats are the property of MOMIMO Jarosław Moryto – NAUTIŚLAWA, 67-410 Sława, ul. Słoneczna 2A, NIP 9251906435, phone 603 656 845.

Translation of the Polish rules displayed on the pier. In case of any discrepancy the Polish version prevails: it is the one the customer signs.

Hours and booking

1. The motorboat rental is open from 10:00 to 19:00. 2. The last rental may start at 18:00; after that hour no boat is handed over. 3. Rental is based on a signed contract. 4. For hourly rental, booking by phone in advance is possible (603 656 845). The renter should arrive 15 minutes before the planned start. Failure to arrive on time counts as cancelling the booking, and the boat may be rented to someone else. 5. Full-day booking is possible. After reserving the date, the renter pays the full-day amount plus the deposit (per the price list) to the indicated account no later than 3 days before the planned date. The payment date is the date the funds reach the account.

Who may rent

6. The renter must read these rules — confirmed by signing the contract — and follow them without exception. 7. Boats may be rented by people aged 18 or over, who can swim and are not under the influence of alcohol or other intoxicants. 8. The minimum number of people on board is 2, the maximum 6 (MARINELLO Fisherman 16), of whom no more than 3 children under 16. The number of children under 16 may not exceed the number of adults on board. 9. The rental may be refused without stating a reason. 10. A boat may be rented by a person presenting an undamaged identity document with a current photograph, and paying the deposit set by the rental.

Deposit and payment

11. The deposit is returned if the rental fee is paid and the equipment returned in no worse condition. If equipment is lost, damaged or destroyed, its return depends on the renter settling the value of the equipment or an amount matching the damage. The rental may deduct from the deposit the damage caused by the renter and the fee for unpaid rental time beyond the declared period. 12. The rental fee is charged before departure ("in advance"), for the declared period. If that period is exceeded, the renter may be required to pay the full rate for each hour started, according to the current price list. 13. Extending the time on the water is possible and requires phoning the rental staff (603 656 845). Staff may refuse an extension if it clashes with the next booking or if there are other reasons against it.

Handover and return

14. On collecting the boat, the renter should check its technical condition and the completeness of its equipment, paying particular attention to any missing safety equipment. 15. By signing the rental document, the renter confirms having received equipment free of defects, as specified and in good technical condition. 16. After returning the equipment in proper condition, the renter receives a receipt confirming the return.

Renter's obligations

17. The renter undertakes to: use the boat, its equipment and fittings as intended; take care of them; carry out no repairs; return the equipment within the declared time; inform other people on board of the duty to follow these rules; look after the safety of everyone on board, including their own; return the boat with its equipment and fittings in no worse condition; cover any repair costs for damage caused through their fault; wear a life jacket or buoyancy aid on board; not consume alcohol or intoxicants and not be on board under their influence; cover the full cost of towing by the police or WOPR incurred through their fault. 18. The renter declares having the necessary knowledge (in particular of motorboating) and having been properly instructed in the use of the equipment.

Prohibitions

19. Renters and people on board are forbidden to: swim while under way, including jumping from the boat into the water; pass the equipment on to third parties; take on board more passengers than the technical (buoyancy) and legal capacity allows; behave in a way that endangers their own safety, that of passengers or of third parties; consume alcohol or any intoxicating substance while in charge of the boat; use the boat other than as intended.

Safety and liability

20. The renter must: follow the rules applying to touring and sport navigation; comply with instructions from rental staff; if damage is found that endangers their own safety or that of passengers, leave the boat immediately and safely and report it to the rental staff on 603 656 845 or WOPR on 601 100 100. 21. The rental accepts no liability for accidents or damage, whether to the renter or to third parties, arising while the boat is in use. The renter waives all claims against the rental for accidents, losses or injuries arising during use of the rented boat. 22. If the equipment, its fittings or accessories are lost through theft or misplacement, the renter must reimburse their value according to the current price list, together with the fee for the rental period. If equipment is returned damaged or incomplete, the renter undertakes to settle the amount set by the rental no later than the return date.

Matters not covered

Matters not covered by these rules are governed by Polish law, in particular the Civil Code Act of 23 April 1964 (Dz.U. 1971 no. 27 item 252, as amended).

Personal data (GDPR)

Under the General Data Protection Regulation of 27 April 2016 (GDPR), and pursuant to its article 13(1) and (2), we inform you that: your personal data is processed for the purpose of concluding and performing boat rental contracts. Providing the data is voluntary. We assure you that it will not be sold or otherwise passed to third parties for commercial purposes, nor transferred to a third country. It is kept for 7 full accounting months from the termination, expiry or performance of the contract concerned. Our processors — a law firm, debt collection companies — may access it for non-commercial purposes. You have the right to access your data, to rectification, erasure, restriction of processing, data portability, objection, and to withdraw consent at any time without affecting the lawfulness of processing carried out before that withdrawal.
